Massage Lawsuit

 
A woman is suing a male massage therapist for sexual misconduct. 
 
During the interview process the male therapist asked the woman if she wanted her breasts and glutes massaged. (both are legit body parts to be massaged)  
 
The woman agreed because she thought the male therapist was gay. Some time after her massage session she found out he was not gay and is now suing him.

Without more evidence, no she should not win. 
The bigger question, should she be forced to pay his legal expenses if she loses? YES!

  Amiche   She thought he was Gay? So it was ok? Really? He isn't Gay so it isn't ok? There is so much wrong with this. I wonder if it was a women giving the massage if it would have been ok, proving she wasn't

  Maria   Basing it solely on this description - RIDICULOUS! However, I wonder if there's more to it...as we learned in the infamous McDonald's hot coffee spill suit, it's not always as it seems.

  jpr318   Did he break the law is the question. If I ask Lisa if I can massage her breasts, massage therapist or not, and she says Yes, then what is the issue? Another ridiculous lawsuit from a woman that should

  october   As long as he didn't tell her he was gay, there seems to be no merit for complaint. Of course the legal question may vary by state and profeesioanl ethic. It would be a shame if the woman won her suit.
